1. Agreement and scope
These Terms form an agreement between you and Ben Baler when you accept them or use the service to the extent permitted by law. If you do not agree, do not use the service. The Privacy Policy explains personal information processing; agreeing to these Terms is not consent to optional analytics or another purpose that requires separate consent.
The application is under development. Features, store availability and integrations described in a preview are not commitments that they are available for purchase. Ben Baler operates from the United States. Contact benbaler@gmail.com for support and legal inquiries.
2. Eligibility
You must be at least 13 to use Aqua AI. Users under 13 may not use the service. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms with you. Additional parental authorization may be required by applicable law. The app remains in development. Public access by teenagers depends on compatible provider terms and appropriate privacy controls; these Terms do not represent that those release requirements have been completed.
You must satisfy the minimum age and any applicable local consent requirements, have the legal capacity or parental authorization required to use the service, and use it only in permitted regions. Store content ratings are separate from contractual eligibility and privacy requirements.
3. Accounts and authentication
The current app uses a persistent guest account. Planned Google, Apple and email authentication will be offered only when configured and available. Use accurate account information and protect your device and sign-in credentials. Tell us promptly if you suspect unauthorized access. We will not ask for your Google or Apple password.
Guest data or access may be lost after uninstall, device reset or loss of the device. Linking a supported sign-in method may be required for recovery. Do not assume that cloud metadata sync includes photo backup, complete cross-device restoration or automatic merging of different accounts. Subscription restoration depends on the relevant store account and entitlement verification.
4. Aquarium information and AI limitations
Aqua AI supports aquarium record keeping, image-based identification, visible-condition observations, catalog information and water-test recording. Automated outputs may be incomplete, inaccurate, inconsistent or unavailable. Similar species, lighting, image quality, test-kit differences and missing context can affect results. Review and correct outputs before relying on them.
The service is informational and is not a veterinarian, laboratory or emergency service. It does not provide a definitive disease diagnosis, certify water safety or guarantee animal health. A photograph cannot establish every water parameter or cause of illness. Follow the test-kit instructions, confirm unexpected readings with an appropriate test, and seek qualified aquatic veterinary advice for illness, injury or urgent concerns. Do not use an AI output alone to select medication, chemical doses or irreversible husbandry changes.
You remain responsible for your aquarium decisions, subject to the consumer rights and liabilities that cannot legally be excluded. Keep separate copies of important records. The app does not guarantee livestock survival, compatibility, breeding results or a particular identification accuracy.
5. Free access and Premium subscriptions
Where offered, free access includes the allowance and features described in the app. Premium is offered as a monthly or annual auto-renewing subscription. The purchase screen and store confirmation identify the available benefits, full price, currency, billing period and applicable offer conditions. An annual plan is charged for the full annual period, not in monthly installments unless explicitly stated.
Apple App Store or Google Play processes your purchase and charges your store payment method on confirmation and on renewal according to its billing rules. Subscriptions renew for successive periods of the selected length unless canceled. RevenueCat helps us validate purchases and maintain access; it is not the store where you cancel or request a store refund.
No free subscription trial is promised. Any future trial or introductory offer must expressly disclose eligibility, duration, conversion price and cancellation terms before purchase. A free scan allowance is separate from a subscription trial. Advertised unlimited access remains subject to safeguards against automation, resale, fraud and abuse; this is not permission to impose undisclosed ordinary-use quotas.
6. Cancellation, restoration and refunds
Cancel an Apple subscription in your Apple Account subscription settings and a Google Play subscription in Google Play’s Payments & subscriptions settings. Cancel before the renewal date shown by the store; for Apple, allow at least 24 hours before the current period ends to avoid renewal. Store rules and any local cancellation rights govern the applicable timing.
Ordinarily, cancellation stops future renewal and access continues through the paid period, unless a refund, revocation or applicable store rule changes that result. Uninstalling Aqua AI, not using it or deleting an Aqua AI account does not automatically cancel a store subscription. You may cancel renewal without first deleting your account.
Use Restore Purchases with the store account that made the purchase where that option is available. A purchase in one store does not automatically create a subscription in another store, and restoration is not a promise to restore locally stored aquarium photos.
Refund requests are handled under the purchasing store’s policies and applicable consumer law. Contact us if you need help identifying a transaction or resolving missing access. These Terms do not impose an absolute no-refund rule or waive mandatory withdrawal, refund or service-quality rights. Price changes will follow applicable store notice and consent requirements and the law.
7. Your content and permissions
You retain your rights in photos, notes and other content you provide. You grant us a limited, non-exclusive permission to host, copy, process, transmit and display that content only as reasonably necessary to provide the requested service, maintain its security, respond to support and meet legal obligations, consistent with the Privacy Policy. This is not a transfer of ownership or a blanket license to sell your photos or use them in advertising.
You must have the rights and permissions needed to submit content. Avoid uploading photos of people or personal, confidential or sensitive information. Online AI processing sends selected content to the provider described in the Privacy Policy; provider data use and development limitations are described in the Privacy Policy.
AI outputs may not be unique or eligible for intellectual-property protection. We do not promise exclusivity or ownership rights that the law does not recognize. General species and equipment information may be reused in the shared catalog; private profile records and corrections are handled as described in the Privacy Policy.
8. Permitted use and intellectual property
Subject to these Terms and the relevant store license, you may use the app for its intended personal aquarium-management purposes. We and our licensors retain rights in the application code, branding, design and licensed catalog materials. Third-party images and open-source software remain subject to their respective licenses and attribution requirements.
Do not bypass access or security controls, misuse another person’s account, interfere with the service, submit unlawful or infringing material, automate bulk scans or extract the service for resale without permission. Reverse engineering restrictions apply only to the extent permitted by law and do not override lawful interoperability or open-source rights. Report suspected vulnerabilities to the support address without accessing other users’ data.
9. Service changes, suspension and termination
We may update the service to maintain security, correct errors, meet legal requirements or improve functionality. We will give appropriate notice of material changes that adversely affect a paid service and provide remedies required by law. We will not rely on these Terms to remove paid benefits without meeting applicable obligations.
We may restrict access where reasonably necessary to address material breach, fraud, security threats or legal requirements. Where practical and lawful, we will explain the reason and provide an opportunity to resolve the issue. Contact support to contest an error. Termination does not remove statutory refund or privacy rights.
You may stop using the service and request account deletion. Use the account deletion page or the in-app deletion request option when connected in your build. Retention required by law may continue as explained in the Privacy Policy. Clauses that by their nature need to survive termination, including accrued payment obligations and applicable liability provisions, continue subject to law.
10. Warranties and liability
We aim to provide the service with reasonable care and skill. Subject to mandatory consumer protections, the service and informational outputs are provided as available, without a promise of uninterrupted operation, complete accuracy or suitability for every aquarium.
To the extent permitted by applicable law, we are not responsible for indirect or unforeseeable losses arising from use of the service. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where protected by law, or any liability, warranty or remedy that cannot lawfully be excluded. Mandatory consumer and data protection rights remain unaffected. Any applicable store license is subject to the same non-waivable legal protections.
11. Apple, Google and third-party services
For an iOS download, Apple’s Standard Licensed Application End User License Agreement applies to the app license unless an approved custom EULA is provided. These Terms address the Aqua AI service and do not replace that store license. Apple and Google are not the operators of Aqua AI or providers of its aquarium advice. Their own terms govern their stores, payment services and sign-in functions.
External websites, catalog sources and third-party services have their own terms and policies. We remain responsible for obligations the law places on us and cannot transfer those responsibilities merely by naming a provider. Availability may depend on device compatibility, connectivity and supported provider regions.
12. Disputes, changes and contact
Please contact Ben Baler at benbaler@gmail.com to seek an informal resolution of a concern. Doing so does not restrict your right to use a court, regulator or statutory complaint process. Applicable law and court jurisdiction will be determined by governing legal rules; these Terms do not impose an exclusive foreign forum, mandatory arbitration or class-action waiver.
Material changes to these Terms will be communicated with an effective date and appropriate advance notice. Where required, we will obtain renewed agreement. Changes will not retroactively take away accrued consumer rights. If a provision is unenforceable, the remaining provisions apply to the extent legally possible.
